AGREEMENT TO TERMS

ShowAffection ("Company," "we," "us," "our," or "ShowAffection") provides a personalized album and gift creation platform ("Services") that enables customers ("Users," "you," or "your") to create, customize, and order personalized products ("Products"). By accessing and using showaffection.com and our Services, you agree to be bound by these Terms of Service ("Agreement" or "TOS"). If you do not agree to all terms and conditions of this Agreement, you may not use our Services.

We recommend that all Users review these Terms frequently, as we update them regularly. Your continued use of our Services following any changes constitutes your acceptance of those changes.

AGE REQUIREMENT

You must be at least 18 years old in order to access and use this website and our Services. By using ShowAffection, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement. If you are under 18 years old, you are not permitted to use our website or Services.

1. INTELLECTUAL PROPERTY RIGHTS

ShowAffection owns or otherwise controls the technology, software, design templates, graphics, artwork, fonts, and all other creative elements that comprise our Services. Users may not copy, modify, reproduce, republish, upload, transmit, perform, display, or distribute any part of our Services or proprietary Content without express written permission from ShowAffection.

1.2 User-Generated Content

When you create Content using our Services (such as personalized text, photo arrangements, and custom messages), the resulting Products combine our proprietary elements with your original contributions. By using our Services to create Products, you agree to the following intellectual property terms:

  • Your Ownership: You retain ownership of original text, photos, and personal information you personally create and input.

  • Combined Works: The final Product-combining your content with our proprietary templates, designs, fonts, graphics, and artistic elements-is owned by ShowAffection. ShowAffection reserves the right to use anonymized or de-identified versions of Products in marketing materials, social media, or product showcases at our discretion, excluding personally identifiable information.

1.3 Permitted Use and License Grant

Our Services and creative elements are provided solely for creating personalized content to be purchased and used for personal, non-commercial purposes. Upon purchase, you are granted a personal, non-exclusive, non-transferable license to:

  • Use and display the Products for personal enjoyment
  • Share Products with family, friends, and personal contacts for non-commercial purposes
  • Request that ShowAffection retrieve previously saved Content to create additional copies of purchased Products

1.4 Prohibited Uses

Users are strictly prohibited from using our Services and Products for any commercial, manufacturing, or profit-generating purpose. Prohibited activities include, but are not limited to:

3. PRODUCT ORDERS AND FULFILLMENT

3.1 Order Confirmation and Accuracy

When you place an order, you are requesting that ShowAffection create and deliver a Product based on your specifications. We will send you an order confirmation via email. You are responsible for reviewing your order for accuracy before purchase. If you notice an error, please contact us immediately at admin@showaffection.com.

3.2 Personalized Products

All Products are personalized and made-to-order according to your specifications. Because each Product is uniquely customized for you, all sales are final. Once production begins, the Product cannot be modified, cancelled, or returned unless it arrives damaged or defective.

3.3 Shipping and Delivery

ShowAffection will make reasonable efforts to deliver your order within the estimated timeframe provided at checkout. However, we do not guarantee specific delivery dates. Delivery times may vary based on location, product complexity, and carrier delays. Once a Product ships, you will receive a tracking number via email.

Risk of loss transfers to you upon delivery to the carrier. We are not responsible for products lost or damaged in transit. We recommend selecting shipping insurance or delivery confirmation options if available.

4. RETURNS AND REFUNDS

4.1 Defective or Damaged Products

If your Product arrives damaged, contains a production error, or you experience a quality issue, please contact us within 7 days of receiving your order at admin@showaffection.com to arrange a resolution. You may receive a refund, replacement, or credit toward a future order at our discretion.

4.2 Return Process

To initiate a return for a defective product, email customer service at admin@showaffection.com to obtain a Return Merchandise Authorization (RMA) number. You will be provided with return shipping instructions. Once we receive and inspect your return, we will process your claim within 14 business days.

4.3 Refund Processing

Approved refunds will be credited to your original payment method. Refunds may take 1-2 billing cycles to appear on your credit card statement, depending on your financial institution. Original shipping costs are non-refundable unless the return is due to our error or a defective product.

4.4 Final Sale Policy

Because all Products are personalized and customized for you, all other sales (non-defective products) are final. We cannot accept returns or issue refunds for Products that do not meet personal preferences, expectations, or subjective satisfaction unless the Product fails to match your specifications due to our error.
